DePuy Lawyers

Following the August 2010 recall of the DePuy ASR XL Acetabular System total hip replacement and the ASR Hip Resurfacing System, many patients began to learn that DePuy Orthopaedics, a division of Johnson & Johnson, may have known about the issues associated with the devices as early as 2007, when tests from an Australian study prompted the company to pull the devices from the market in Australia.

Additionally, in March 2010, a letter was sent to doctors informing them about serious issues associated with the hip devices, though patients were not directly informed until the recall occurred in August 2010.

Hundreds of patients are now seeking compensation from DePuy for medical bills and additional expenses associated with the faulty hip devices. If you would like to receive additional information about your legal options, please fill out the form on this page.

How a Lawyer Can Help

Utilizing a lawyer may help patients obtain compensation for painful side effects associated with the DePuy ASR XL Acetabular System total hip replacement and the ASR Hip Resurfacing System, such as:

  • Metallosis: Characterized by rashes and nerve damage, metallosis is a condition that can occur when the metal-on-metal movement of the implant causes friction and releases higher, potentially dangerous levels of chromium and cobalt ions into the body.
  • Loosening of Hip Implant: The complication may cause patients to experience limping and difficulty walking. This often prompts the patient to transfer too much weight to the other hip or joints, resulting in additional pain and possible joint or bone failure.
  • More Surgery: Many of the side effects associated with the DePuy ASR devices require a patient to undergo additional hip replacement surgeries. Unfortunately, each additional surgery typically has a shorter life span than the previous replacement surgery.

Additionally, speaking with a lawyer may help patients receive compensation that DePuy may not otherwise provide.

Patients who received the DePuy ASR XL Acetabular System or ASR Hip Resurfacing System, may have received correspondence from DePuy regarding the recall of these devices. Prior to seeing a doctor and signing any paperwork provided by DePuy and/or Johnson & Johnson, patients may wish to speak with a lawyer about their legal rights, as patients who sign documents from DePuy may be signing a waiver. This waiver may prevent patients from receiving any additional compensation from the company, should medical complications arise in the future.

Currently DePuy is providing some compensation to patients following the recall of the ASR devices, but the compensation is not comprehensive and may not cover expenses incurred following hip replacement surgery. The compensation and does not cover many diagnostic tests or blood tests that may be required to ensure a patient is healthy and to check for metallosis.

The assistance provided by DePuy also may not cover pain and suffering, lost wages and loss of earning capacity.
